NASPGHAN has joined the American Academy of Pediatrics, the Children’s Hospitals Neonatal Consortium, the March of Dimes and other organizations in submitting an amicus brief to the U.S. Supreme Court related to litigation involving necrotizing enterocolitis (NEC) and preterm infant formula.
The brief supports a petition for certiorari asking the Court to address the concentration of NEC cases in certain Illinois courts, including cases involving infants who were born, treated and received nutrition products outside of Illinois.
NASPGHAN and the other participating organizations are serving as neutral, academic authorities, providing the Court with important medical and scientific context regarding NEC, preterm infants and the role of preterm infant nutrition.
The brief also highlights concerns about the potential impact continued litigation could have on the availability of specialized nutrition products for premature infants.
